ive overstayed my 3 months visa


and found out that im pregnant


what can i do?

you CANNOT live and work in the US, you do not have a visa and cannot quickly get one that will allow you to work.





Did you have a VISA or did you come on the Visa Waiver program? If you have a visa you may be able to apply for an adjustment of status but it's usually VITAL to do it before you are out of status (as you are now). Still that is your only avenue at the moment unless you get married. Even if you get married at this point they may want you to go home and apply for a green card and waiver of ban due to overstay.





If you are not very much over, say only a few weeks, I'd take a chance and contact CIS to ask what you can do, saying your overstay was due to your pregnancy.

Many visitors particularly ladies who travel to USA on a Visitors (B-2) Visa, and the overstay is due to pregnancy, can apply extension of Visa.


Immigration Officer can grant to a Visitor possessing B-2 visa is six months. The USA Immigration laws however has a provision whereby it is possible for the holder of a Visitor鈥檚 Visa to apply for an extension of time granted to him for stay in USA. The maximum time, which can be granted, upon such Extension Applications, is in aggregate one year. Currently, the Immigration Authorities take long time to process and answer such Extension Applications.





Further Section 212(a)(9)(B)(i) imposes two types of bars for people who overstay without a valid permission. If the overstay is for a period of 180 days or more the person who overstays is then precluded from re-entering USA for a period of 3 years from the date he leaves USA. If a person has overstayed without valid permission for more than a year then after he leaves USA he cannot re-enter USA on any category of visa for a period of 10 years
