I'm US citizen and planing to getting married in india this september to indain citizen girl. The question that i have is what is the best way to petiton for her so she can come to US in less time. I heard that one has to stay in india for two months to file for marriage petition , but because of my work situation i can only stay in india for 3 weeks, so i'm not sure if i can apply her on marriage visa or do i need to file finance visa for her. I would like to know what are the procedure in either situation. thanks in advance. !US Citizen need advice on marriage laws in India?
Option 1: Go there get married and wait for up to 3 years for her to come here.
Option2: GO there get married, come here file for K Visa Fiancee Visa, inform the USINS that you plan to marry her once she is here and you visited India and met here there.
It will take her about 6 months to come here, once she is here get married by a Justice of the Peace in your state. Apply for her status change, and work permit, She will be able to live here with you and even work if she wishes to and will get her green card in about 1 year.
