I am a US citizen in Brazil with my girlfriend, a Brazilian citizen, who is now pregnant. Any advice?

I am planning on returning to the US on May 19 and would like her to come with me. But what about her having a baby in the US on a tourist visa? Is this AT ALL legal? Also, what will hospitals say about this? Also, can I buy health insurance for her in the US? We have so many questions and we're fortunate to have this resource to help us. I see a mixture of good and really inaccurate information here.





First off you child will be a US Citizen wherever born as long as you acknowlege him as yours and you have yourself lived in the US a number of years after the age of 14, I believe 5 years total residence is required at least 2 after 14 but may have that wrong.





Second yes it will be difficult to get a tourist visa if they find out the situation. IF... and you can't lie or you damage your chances to get in ever.





Third marry her there or in the US either way she can fairly promptly get a green card, but it you do it in the US she can stay under most circumstances while she waits for the paperwork. It will probably take at least 6 months if she is in Brazil.





Fourth the only way I can think of to get her insurance is to marry her, assuming you have insurance. No one will voluntarily issue an insurance policy to a pregnant woman that will cover pregnancy.





Normally your (work provided) insurance will automatically allow you to add her to your insurance and those insurance policies have to include her pregnancy and usually preexisting conditions as well.





Unfortunately they don't normally offer any but emergency services outside of the US if that. And pregnancy would not qualify. So you need to get her to the US and marry if you can.I am a US citizen in Brazil with my girlfriend, a Brazilian citizen, who is now pregnant. Any advice?

Why does she not apply for a tourist visa and see if she will be granted one? If she will, then you can marry her in the US right away and file her paperwork with the USCIS to sponsor her under a spousal petition.





In case she will not be granted a tourist visa, then you can marry her in Brazil file for her paperwork and wait until she gets to America. This is the second quick way.





If she is able to get in the country then you can pay for her medical expenses which will be very expensive but that it the way it goes here. It will take time before she can be under your insurance or even acquire her social security number to qualify for insurance.
She does not have a big chance to get a tourist visa, sorry. For getting a tourist visa she will have to prove that she has very strong ties with Brazil, and has no intentions to stay in the US. Unfortunately, having a US citizen boyfriend and being pregnant with US citizen baby shows opposite. Consular officer will think that she wants to evade immigration laws, trying to get a tourist visa for moving to the US, because getting a tourist visa is faster than waiting for fianc茅e or spouse visa.
Like some answerers before said.......it'll be hard for her to get a tourist visa. The fact that she is pregnant is a give-away that she intends to come and stay in the US. And if she gets it, she'll still have a tough time convincing the Border Patrol (customs) that she intends to stay in the US temporarily.





Your best bet would be to decide if you want to marry her and if you want to marry her in Brazil or in the US. If in the US, then you can apply for her to get a fianc茅e visa. And then once she comes to the US you have a 90-day persiod in which you must be married before the visa expires. If you want to marry in Brazil, then you will petition for her to come to the US as your wife. In this case you will need to file an I-130 to petition for her. But first you need to check with the US Consular office in Brazil, because some offices refuse to accept jurisdiction.

Getting a tourist visa is hard these days for most people.


The first thing you need to do is visit the US Consulate and ask how long it will take to process a fiancee visa. This visa requieres you to marry her within a certain period of time, or, she has to leave. You may also want to ask about the option of marrying her in Brazil and having her come as your wife. it may be a little faster that way. I hear processing these types of visas is taking longer these days, so good luck.
Its 100% legal for her to have a baby even if she has a tourist visa. No health insurance will cover her, reason being that she is on a tourist visa, she would need to be on residence visa or a US citizen to get health coverage.
Does she have a visa to come to US.....if not you must either marry her in Brazil or you could ask some information about a fiancee visa for her right now, if she has the visa bring her to US and tell the immigration that麓s she is just visiting ,I don麓t know how pregnant she is. Then once she is here don麓t worry about anything marry her as soon as you can and apply for her to have a green card. If she lived here before or was deported it麓s more complicated if you explain better your situation I can help maybe......


Anyway....she can have a baby here no problem and if she has no insurance you must prove that you can pay for her or include her and your baby to your plan 麓cause you麓re the sponsor and if you can麓t pay right now...you can always apply for free care....check your state.....

Why don't you do the honorable thing and marry her? If you didn't plan on marrying her, why would you make a baby with her?
Do the honorable thing, marry her and stay in Brazil now that you have a family there.

Sorry guy, but I will advise you on the opposite hand: make your baby to born in Brazil. It will be nice for him/her.





Brazil has no enemies and people around the World tends to prefer a Brazilian to a US citizens due to the acts of your government for decades.





Besides this, ';Uncle Sam'; will never point the finger to him saying ';I want you'; when another retard like George Bush invent a terrorism to make a new war. Keep him/her safe, in Brazil.





When your son/daughter to become an adult, he will be satisfied to have friendship and relation with Brazilian girls, considered the most sexy in the World. If a girl, a Brazilian girl, she will say ';I'm one of them';.





Brazil is a nice country, a multi cultural nation and nobody makes enemies here or around the World. We have not any racial conflicts and our culture don't permit explicit racists like you have (KKK) in USA.





Brazil has excellent schools and universities, the economy is strong and growing. Our GDP is largest than some nations of G7 and will grow up more and more.





Brazil is a modern nation. Supermarkets has everything and the prices are not expensive. Cars are commons, everybody has cell phone and electronic goods. You can find anything at shopping centers. You can choose a good academy to stay fit and you have good doctors with excellent equipment in Brazil. So, there's no motif to leave Brazil for living in USA. I think the life of your family will be better in Brazil. It's my opinion.
